There are just some people will take chairs as long as there is nobody sit. Even if the chair belongs to that table. Maybe they think they are guest and some think that they are owners, they have the right to take any chairs they want.
Please! Ask before you sit, if not later the person come back and he/she don't have any seat. Imagine you are the one, how would you feel, even if there is seats somewhere else but its still not a good feeling.
